The red line of cultivated land cannot be trampled on, and 4 kinds of illegal agricultural behaviors will be cracked down!

1. Photovoltaic power stations growing in farmland?

Although the mainland is the largest producer of grain, it is also the world's largest grain importer, mainly because of its large population and small per capita land resources.

Therefore, the state has repeatedly stressed that it is necessary to strictly abide by the red line of 1.8 billion mu of cultivated land, guard the 1.55 billion mu of permanent basic farmland, and prohibit the conversion of cultivated land to other agricultural land, or the construction of "non-grain" and "non-agricultural".

However, CCTV's "Financial Survey" recently exposed a typical destruction of basic farmland, and the news was shocking.

According to reports, some basic farmland in Xiaogan townships has been illegally occupied. Among them is Muzi Township, Anlu City, which was once a famous grain-producing township in Xiaogan, but it was targeted by capital and changed the high-standard farmland with drought and flood protection into a photovoltaic power station.

As we all know, high-standard farmland is high-quality fertile land that the mainland has focused on building, and only land that is concentrated and contiguous, evenly distributed, has perfect water conservancy facilities, has good soil and ecology, has high and stable yields, and can be called high-standard farmland, and the land nature of these farmlands is permanent basic farmland.

It is understood that in 2019, Muzi Township spent 8.2917 million yuan to build high-standard farmland that meets national standards, making the field roads hardened, no longer the muddy roads of the past, and drainage and irrigation are very convenient.

For the local people, since the completion of high-standard farmland, everyone's grain yield per mu has stabilized at about 1,500 catties, and there is no need to worry about the shortage of water in the dry season, and the income of farmers per mu can reach more than 1,000 yuan.

Two years later, the village cadres mobilized the villagers to lease their farmland to a photovoltaic company, which was called supporting the "agriculture and photovoltaic complementation" photovoltaic power generation project.

From the announcement of the local government, it can be seen that this project covers an area of 2,000 acres, with an investment of up to 350 million yuan, which can be described as a large amount. However, such a large investment only gives the peasants a circulation fund of 500 yuan per year.

The villagers are naturally unwilling, the local two crops a year, each mu of land can earn more than 2,000 yuan a year, but the rent out is only 500 yuan return.

Who knows, the grassroots cadres forced the relevant villagers to sign lease contracts, and the villagers dared to be angry and did not dare to speak out because of the "deterrence" of the grassroots cadres.

Soon, a large number of high-quality fertile fields "grew" photovoltaic power stations, but the villagers soon found the problem, the power station was noisy, the villagers had a problem sleeping, and many of the land was forced to become "wasteland", which made the old people in the village feel distressed.

2. Suspected of fraudulent subsidies

According to the policy of "agriculture and photovoltaic complementation", photovoltaic panels can be placed on agricultural greenhouses, which can be used to grow vegetables, crops or breed, so as to win two incomes.

However, local villagers complained that this was just a formality to defraud the state of subsidies, and although the photovoltaic power station was built, the farmland was abandoned.

CCTV reporters investigated and found that the so-called "agriculture and photovoltaic complementation" in the local area is just a formality, just to be approved.

The villagers also said that although the company sent people to plant the land, it was only superficial to deal with the project assessment of the superiors, and the rice yield of one mu was only 300 catties, which was 1,200 catties less than the actual one. Obviously, the company doesn't want to make a profit from the yield of the farmland, just to subsidize it.

Judging from the land certificates in the hands of the villagers, the land occupied by the photovoltaic power station is permanent basic farmland. According to Article 35 of the Land Management Law, as long as the permanent basic farmland is demarcated, no unit can occupy or change its use, and naturally no photovoltaic power station can be built on the farmland.

However, the relevant departments of the state have repeatedly reaffirmed that local photovoltaic power generation projects cannot occupy permanent basic farmland, basic grassland, Class I forest land, etc., and no one can change their use. Villagers found that the farmland with photovoltaic panels was no longer suitable for rice cultivation due to insufficient sunlight.

But when the reporter interviewed the local village cadres, the relevant person in charge said that this was a wasteland that no one planted, so he opened his eyes and said nonsense, which made people wonder who he was standing for?

3. The red line of cultivated land should not be trampled on

Since the basic farmland cannot "grow" the photovoltaic power station, who approved the completion of the Muzi Township project?

A staff member of Xiaochang County told reporters that the use of "stealing beams and changing pillars" is a crooked scripture, the county first transferred the basic farmland to rebuild photovoltaic power stations, and then transferred wasteland, forest land and other non-arable land to basic farmland, but such a large-scale operation needs to be operated by relevant departments at the provincial level.

The Land Management Law clearly states that it is forbidden to adjust the land use planning at the county level and in townships without authorization, which means that ordinary cultivated land and basic farmland cannot be exchanged. The land fertility, ecology, disaster resistance, and irrigation of ordinary cultivated land are far inferior to basic farmland, and its grain output is small, and turning it into basic farmland is the biggest threat to China's grain and a manifestation of trampling on the red line of cultivated land on the mainland.

As early as September 2020, the State Council promulgated the Notice on Resolutely Stopping the "Non-Agricultural" Conversion of Cultivated Land, which particularly emphasized that local governments cannot approve land in violation of laws and regulations, and that county and township land and spatial planning should avoid the occupation of basic farmland.

A photovoltaic company obviously does not have so much energy, and behind it must be the "stealing of the sky" of some cadre groups, which seriously damages the burden of farmers.

The reporter also found that there are also more basic farmland "agriculture and light complementation" projects in other places in Xiaogan, such as Xiaochang Huaxi Township, as a local food township, but there are at least 7 contiguous photovoltaic power stations, which seriously damage the local cultivated land environment.

However, the relevant personnel of the photovoltaic power station said that although the power generation capacity reaches the standard every year, due to the relatively cheap electricity price and power rationing, coupled with the excessive restriction of power generation, the photovoltaic benefits are not satisfactory, and the cost cannot be recovered at all.

But even if it is known that the income of the first phase of grid connection is not good, Huaxixiang is still urgently preparing for the second and third phases of the power generation project, is this really for the state subsidy?

The local government can be described as "loving" for photovoltaics, and does not hesitate to take a huge risk to change the nature of basic farmland, but I don't know what the real intention behind it is.

Today, the photovoltaic industry has grown savagely in some parts of Hubei, but if it really touches the red line of farmland for the sake of the project, it is naturally an unhealthy industry.

Fourth, four kinds of agricultural behaviors should be cracked down

In fact, since 2018, the state has begun to focus on cracking down on "non-agricultural" and "non-grain" agricultural behaviors such as "big greenhouses".

Every year, the No. 1 document of the central government will emphasize the protection of cultivated land and focus on cracking down on illegal occupation or destruction of cultivated land. Document No. 1 of 2024 is naturally no exception, continuing to put forward more high-pressure requirements.

In addition, the Office of Natural Resources also announced that it will carry out normalized "health film law enforcement" in 2024 to crack down on various illegal agricultural behaviors. "Sanitation law enforcement" is the use of satellite photo comparison, one by one to investigate illegal occupation and other agricultural behaviors, once found violations, the local department will focus on punishment.

Document No. 1 in 2024 and law enforcement both proposed that the next step will be to focus on cracking down on four agricultural behaviors.

1. Occupy farmland to build houses

In the past, many farmers illegally built houses on farmland to live in, and their houses were forced to be demolished because they believed that their contracted land was free to be used.

However, in recent years, the non-agricultural construction in some areas has intensified, and they first used breeding and vegetable greenhouses to apply for facility land, but after approval, they carried out non-agricultural construction in them, such as building farmhouses, homestays, fish ponds, reinforced concrete pig farms or factories, etc., which are all illegal acts.

Since 2020, the state has "zero tolerance" for the construction of houses on cultivated land and non-agricultural construction, and will focus on dealing with violations when they are found.

2. "The Great Terrace"

Since 2018, the state has carried out a special cleanup of "big sheds" across the country, and 168,000 problematic "big sheds" have been found in just half a year.

These greenhouses are applied for on the grounds of plastic greenhouses, but they are built in greenhouses for accommodation, catering, office, etc., which seriously violates the nature of the land, or turns the "ear houses" into luxury villas.

It can be seen that the large shed completely violates the original use of the land, which has caused serious damage to the farmland. In this year's No. 1 document, the focus is once again on the management of "big sheds", and the "resurgence" of some areas is dealt with with a heavy blow;

3. Illegal soil extraction

In recent years, the black soil in Northeast China has been subjected to a very rampant problem of illegal excavation, and countless black soil has been dug out of large pits and irreparably damaged.

The black soil has high fertility, a lot of humus, and a high yield of crops, but some unscrupulous businessmen have dug it in various ways and ways, which is really unbearable.

Of course, illegal land extraction is not only in the three eastern provinces, but also in many parts of the country. In particular, during the construction of highways and other engineering projects, many units have taken a large amount of soil from cultivated land, causing serious damage to cultivated land.

This year's No. 1 document emphatically pointed out that the focus will be on cracking down on illegal land grabbing, and if it is serious, he will be criminally detained and investigated for criminal responsibility in accordance with the law.

4. Dig the lake for landscaping

In recent years, in order to develop tourism or other commercial purposes, some areas have destroyed cultivated land without authorization on the grounds of river and lake management, and dug fields in them to create landscaping, such as building parks, lakes, and artificial landscapes.

There are also some places that occupy farmland in scenic areas, illegally build villas, and build golf courses, which are all illegal acts.

For those who destroy cultivated land or basic farmland in violation of regulations, no matter what illegal construction they are engaged in, as long as they destroy more than 5 mu of basic farmland and more than 10 mu of cultivated land, they will be guilty of the crime of illegal occupation of farmland, and the court may sentence them in accordance with the law.

This time, some areas of Xiaogan, Hubei Province occupy basic farmland for the construction of photovoltaic power plants, which is obviously a typical crime of illegal occupation of farmland, and I hope that the local government can enforce the law impartially and say "no" to all illegal land destruction!
